On October 1, 2024, the Opposition Division of the EPO confirmed SafeSize’s European patent EP3523601, rejecting the opposition filed by Volumental AB, a competitor in the foot scanning market. The decision confirms that SafeSize’s European Patent EP3523601, which covers sensor technology of the SafeSize 3D Foot Scanner, is upheld in full.
As a result, SafeSize retains exclusive rights to the patented 3D Foot Scanner technology across 24 countries – member states of the European Patent Organization, whereas the protection is extendible up to 2036, meaning that unauthorized manufacturing, offering for sale or sale, importation, or use of such technology without SafeSize’s permission may be subject to legal action against patent infringement in the respective countries. After an earlier positive decision by the EPO’s Examining Division, the new ruling reaffirms the novelty and inventive step of SafeSize’s patented technology, providing the company with a significant competitive edge in the footwear retail technology sector.
